Alan Ellis was the first person to be prosecuted for illegal file-sharing in the United Kingdom. The admin of OiNK has been acquitted of conspiracy to defraud in a trial that was closely-watched by the music industry and file-sharers.
According to a short message on the website, Alan Ellis was found not guilty through a unanimous jury decision.
The website was closed down in October 23, 2007 after a two-year investigation conducted by the International Federation of the Phonographic Industry (IFPI) along with the British Phonographic Industry (BPI). But to the surprise of both agencies, OiNK was just replaced by two similarly music-oriented BitTorrent trackers - What.cd and Waffles.fm.
Since the said closure, the authorities have been trying to figure out exactly how and with what to charge Ellis. They extended his bail over four times until they finally settled with conspiracy to defraud in September of last year - well past the initial deadline imposed which was December 21, 2007.
His trial kicked off last week following a brief court appearance last month. It was quickly evident that many from the prosecution didn’t really know how the site worked.
Prosecutor Peter Makepeace accused Ellis of allegedly soliciting site donations that were deposited directly to the admin’s PayPal account instead of to the artists who owned the music being shared in the site.
